A Texas family recently sued when their dog Avery escaped from the back yard and was mistakenly euthanized by pet control. The Supreme Court of Texas ruled that the family could not sue for more than the market value of the dog, and that “emotional damage” was not relevant to the settlement.

So the question is, do you think emotional injury damages should be recoverable in the negligent destruction of a dog? Or do you think a family should only be reimbursed for the cost of the dog, because pets are personal property.
